Please complete and eLodge on the eCourts Portal of Western Australia a Request to Attend by Electronic Means form
You must ask the other party whether they agree to you attending the court event by telephone. You will be required to provide details of the date on which you asked the other party for their consent and whether or not they agreed in Part E of the Request to Attend by Electronic Means.
You can provide the telephone number on which you want to be called in the space provided at Item 9 of the Request to Attend by Electronic Means. If your Request is approved, then no further action from you is required. The Court will call you on the telephone number provided at (or within an hour of) the time scheduled for your court event.
If you do not want the other party to know your telephone number for safety reasons, you do not have to provide it in the Request to Attend by Electronic Means. Instead, once your Request has been approved, complete the Telephone Attendance Booking Form and email it to: family.court@justice.wa.gov.au.
Once you have emailed the booking form to the Court, no further action is required by you. The Court will call the person specified in the form on the telephone number provided at (or within an hour of) the time scheduled for the court event.
If you or one of your witnesses wishes to attend the trial by telephone, you should discuss this with the judicial officer at the Readiness Hearing. You should also confer with the other party/parties in your case and try and reach agreement about those arrangements prior to the Readiness Hearing. If appropriate, the judicial officer may make orders at the Readiness Hearing about the attendance at trial by telephone.
If no orders have been made, then no later than 28 days prior to trial you will need to eLodge an application in a case seeking an order for attendance by telephone, together with an affidavit in support.
As to the information that you need to include in the affidavit, see affidavit requesting to attend trial by electronic means.
If you or one of your witnesses is permitted to attend the trial by telephone, you must provide the Court with the telephone number on which they can be contacted as soon as possible and certainly no later than 7 days prior to trial. You can do so by completing the Telephone Attendance Booking Form and emailing it to family.court@justice.wa.gov.au.
Once you have emailed the booking form to the Court, no further action is required by you.
