Nullity or declaration as to validity

This page has the requirements for applying for:

• an order that a marriage is a nullity
• a declaration as to the validity of a marriage, or
• a declaration as to the validity of a divorce or annulment of marriage.

You need to file:

• an Initiating Application (Form 1), and
• an affidavit

Contents of the affidavit

The affidavit needs to state:

• the facts your application relies on, and
• for an application that a marriage is a nullity:
  • details of the type of marriage ceremony performed
• for an application as to the validity of a marriage:
  • details of the type of marriage ceremony performed, and
• for an application for a declaration as to the validity of a divorce or annulment of marriage:
  • the date of the divorce or order of nullity
  • the name of the court that granted the divorce or order of nullity, and
  • the grounds on which the divorce or order of nullity was ordered.
